13. SEVERABILITY. The obligations under this agreement are separate and divisible and, if a clause is found to be unenforceable, the balance of the agreement remains fully in force and effective. CARRIER agrees that Broker is solely responsible for paying CARRIER`s invoices and that CARRIER will not request payment from the sender or recipient. 14. FULL AGREEMENT. This agreement, along with each confirmation carrier, is the full representation of all agreements between the contracting parties and replaces all previous agreements and agreements between the contracting parties. Supplements and amendments to the content of this agreement are binding only if they are recorded in writing in a document dated by both parties and signed by both parties. 12. CONFIDENTIALITY. CARRIER and BROKER agree that the terms and conditions of this contract, in addition to any other information relating to the activity of customers and shippers, are confidential and will not disclose any of their contents or information about services provided under this contract without the written permission of a party participating in this contract or in accordance with the law. CARRIER expressly agrees that all cargoes offered by Broker are transported on aircraft that are operated only under carrier supervision and that CARRIER cannot under any contract, broker or other form, including other modes of transport, ensure that cargo is transported by a third party without the prior written agreement of broker. 1.
GENERALITIES. The aim of this agreement is to outline the agreement between the two parties acting as transport service providers or transport intermediaries. Each of the shipments under contract between the two parties will be included in a freight confirmation accompanied by an attached cargo sheet, provided by Broker. Carrier`s confirmations are therefore an integral part of this agreement. 3. BROKER REPRESENTATIONS. Broker is employed in the provision of freight brokerage services, granted by the Federal Motor Carrier Safety Association (FMCSA).
